Terms and Conditions

  1. Introductory Provisions

    These terms and conditions define the relationship between:

    as the seller and operator of the online store www.yorq.eu, and the customer, who enters into a purchase contract with the seller.

    The seller treats all customers equally, offering the same benefits regardless of whether they are consumers or businesses. Consequently, all customers are subject to the provisions outlined in these terms and conditions.

    These terms and conditions are primarily intended to govern the purchase of goods through the online store.

  2. Conclusion of the Purchase Agreement

    A purchase agreement may be concluded remotely via the online store or customer service line.

    For contracts concluded remotely, an order placed either online or via the customer service line constitutes an offer to enter into a purchase contract.

    The order remains valid for seven (7) days, during which the seller confirms receipt by email. The contract is concluded when the seller accepts of the offer by dispatching the ordered goods, with a dispatch confirmation sent to the buyer by email.

    The seller supplies goods to customers only in quantities typical for household consumption. In certain cases, such as during discounts or clearance sales, the seller may set a maximum quantity limit per customer.

    Orders are submitted on the online store by clicking the "Order" button. The terms and conditions, along with order details, are archived for six years.

  3. Right of Withdrawal

    By law, the consumer has the right to withdraw from an contract concluded over the internet or by phone without cause within 14 days of receiving the goods.

    The seller extends this 14-day withdrawal right to all customers, whether they are consumers or business entities.

    To exercise this right, the customer must inform the seller of their decision within the stated timeframe, preferably via email at info@yorq.eu or by phone, as listed in the Contact section.

    A template for withdrawal is provided below these terms and conditions.

    If the customer withdraws from the contract, the seller will refund the purchase price of the goods, without undue delay, and no later than 14 days from the date of withdrawal. However, the refund may be withheld until the goods are returned to the seller. The refund will be made using the same payment method used by the customer unless  otherwise agreed.

    Please note that customers are liable for any reduction in the value of the goods resulting from handling other than as necessary to assess the nature, characteristics, and functioning of the goods. Customers may not withdraw from the contract for goods customized to their specifications or for hygienic reasons.

  4. Complaints

    If the goods have a defect upon delivery, the seller may agree with the customer to provide compensation in the form of a voucher.

    The customer is also entitled to request rectification through the replacement or repair of the defective item. If this is impossible or disproportionate for the seller, the customer may request a price reduction or, if it is a significant defect, withdraw from the purchase contract.

    These rights apply even if the defect becomes apparent at a later time.

    The seller is liable for defects that manifest within two years of delivery.

    A defect is considered to exist if the goods lack standard or advertised qualities, do not serve their intended purpose, do not meet legal requirements, or were delivered in a quantity different than agreed. Increased sensitivity or allergic reaction to the goods does not in itself constitute a defect. Product images on the online store are for illustrative purposes only and do not represent binding characteristics of the goods.

  5. Payment and Delivery Methods

    The customer may select from the available payment and delivery options. Before placing an order, the customer will be informed of the selected payment and delivery methods, along with the associated costs.

    Delivery times are approximate and based on the estimated delivery times of carriers.

    The seller reserves the right to offer free delivery in selected cases.

  6. Miscellaneous Information

    The seller may provide various discounts, gift vouchers, or other types of vouchers. Unless otherwise specified, each discount or gift voucher is valid for a single use, and only one voucher of the same type may be applied per purchase. If the voucher's value exceeds the total purchase amount, no change will be given.

  7. General Information

    The entity for out-of-court dispute resolution, or to whom customer complaints may be addressed, is the Czech Trade Inspection Authority at Štěpánská 567/15, 120 00 Prague 2, ID: 000 20 869, website: https://www.coi.cz. The customer may also resolve disputes online via the designated ODR platform.

    The contract is governed by Czech law, and the disputes shall be settled by an objectively competent court in Brno (Czech Republic).

    All product and service prices include VAT valid at the time of order submission. If VAT changes before the contract or goods are dispatched, the customer must cover any shortfall, or the seller will refund any overpayment.

    By submitting an order, the customer consentsto receive the tax document electronically. A hard copy can be sent upon request.
